Please read these Terms of Use carefully. These Terms of Use govern your access to and use of this site, https://connect.hoopp.com and its related URLs (“HOOPP Connect”). HOOPP Connect is provided to the user of the site ("you") by the Healthcare of Ontario Pension Plan Trust Fund ("HOOPP"). By logging into HOOPP Connect, you indicate you understand and agree to these Terms of Use. If you do not agree to these Terms of Use, you must immediately stop using HOOPP Connect.
Users
You confirm that you are a HOOPP member acting on your own behalf. No other person may access HOOPP Connect, including individuals acting on behalf of a HOOPP member, such as a spouse, family member, authorized representative, Power of Attorney, Guardian for Property, Executor, or Estate Trustee. Individuals acting on a member’s behalf are required to contact HOOPP’s Member Services for assistance.
Information security
You will ensure only you can access your HOOPP Connect account. You agree not to share your HOOPP Connect password or security question answers with anyone. You will make best efforts to prevent anyone else from accessing your HOOPP Connect account. These efforts will include signing out of HOOPP Connect and closing your browser after each session and ensuring your computer or other device has adequate and up-to-date security software. You agree to accept responsibility for all activities that occur under your HOOPP Connect account, including any instructions, elections, or designations provided to HOOPP under your account.
You alone are responsible for the security of your password, User ID, and other personal identifiers. If you suspect your password or any other personal identifier, such as your Social Insurance Number (SIN), has been compromised or that someone else has accessed your account, you will immediately contact HOOPP's Member Services for assistance. HOOPP is not responsible for any damages arising from your failure to secure your HOOPP Connect account.
HOOPP takes every reasonable precaution to ensure your information is secure; however, HOOPP cannot guarantee the privacy of information you share on this site. HOOPP is not responsible for any damages arising from your use of HOOPP Connect, including damages arising from sending or receiving personal or confidential information through this site.
You agree to only use HOOPP Connect as intended in accordance with these Terms of Use and not to, nor make any attempts to, take any actions that may adversely affect HOOPP Connect, including any actions to:
Privacy
You agree that any information you provide through HOOPP Connect will be accurate, true, and complete and that you will update your information to keep it accurate, true, and complete. You understand that HOOPP collects, maintains, uses and, when necessary, discloses your personal information for the purpose of administering the HOOPP Plan and providing you the services on HOOPP Connect, as set out in the HOOPP Privacy Statement.
You understand and agree that HOOPP may use certain personal information (such as your User ID, SIN, password, or other identifier) to verify your identity and provide you with access to this site.

Connect is not intended to provide specific individual financial, legal,
investment, pension, or tax advice.
HOOPP
Connect contains information about the benefits in the HOOPP Plan Text. HOOPP
reserves the right to interpret the HOOPP Plan Text and make amendments to it
from time to time. In cases where the information provided on this site differs
from that contained in the HOOPP Plan Text, the HOOPP Plan Text and applicable
legislation in effect at the relevant time will govern. HOOPP makes its best
efforts to ensure the information on the site is accurate, complete, and
up-to-date; however, as the information is subject to change at any time, it
may be inaccurate, incomplete, or out-of-date.
Estimators and other tools
Tools on this site that calculate estimates or that provide guidance for making certain benefit decisions are for informational purposes only. These tools may use information HOOPP has on file for you (provided by you or your employer), as well as any information you enter. These tools may also make actuarial assumptions and assumptions about your personal circumstances. If any information or assumptions are incorrect, including any information you enter (or omit), the output will not be accurate or applicable to your circumstances.
Information you enter into an estimator or other tool may be aggregated with the information of other users and used by HOOPP to better understand our membership and to enhance the experience of users of the tool.
HOOPP will not use information you enter into an estimator or other tool to calculate your or your spouse’s benefit entitlements or other amounts under the HOOPP Plan. Actual benefit entitlements or other amounts will be calculated based on verified data and in accordance with the HOOPP Plan Text and applicable legislation in effect at the relevant time. The estimates provided by the tools on HOOPP Connect do not convey any actual entitlement to benefits or other amounts under the HOOPP Plan and are not binding on HOOPP.
Before making any decisions or providing any instructions, elections or designations using the output from the tools on this site, you are responsible for ensuring you have considered all relevant information and should consider consulting appropriate professional advisors.
Online transactions
You may provide various instructions, elections, and designations regarding your benefits to HOOPP on HOOPP Connect. HOOPP will rely on any such actions made under your HOOPP Connect account as your authorization to process your benefits or update your record accordingly. HOOPP will not act if it determines any such action to be illegal, unclear, inaccurate, improper, or not properly authorized or where HOOPP has not been provided the information or documentation it requires to act.
You agree to review any information HOOPP provides to you (on paper or in electronic form) regarding any actions you take on this site. If there are any inaccuracies or other issues, you agree to immediately correct them on this site or contact HOOPP's Member Services for assistance.
Liability
In no event will HOOPP, its Trustees, Officers, Employees, Contractors, Agents, Affiliates or Licensors (collectively “HOOPP Representatives”) be liable for any direct, indirect, consequential, or exemplary damages arising from the use or the performance of this site or from any inability to access this site as a result of technical error or malfunction, even if HOOPP Representatives have been advised of the possibility of such damages. The foregoing limitations and exclusions will apply irrespective of the nature of the cause of action, demand, or claim, including in the nature of a breach of contract, tort (whether for negligence, gross negligence, or otherwise) or any other legal theory.
HOOPP may at any time, and without notice to you, terminate your right to use this site or cease to provide this site. This provision will survive the termination of your right to use HOOPP Connect.
Proprietary rights
HOOPP, the HOOPP logo and other identifying marks of HOOPP are and shall remain trademarks of HOOPP, and any unauthorized use of these marks is unlawful. You acknowledge and agree that all copyrighted materials, trademarks and other intellectual property and proprietary rights of any and all content on this site is the property of HOOPP or its licensors (“HOOPP Materials”). Nothing contained on HOOPP Connect or these Terms of Use will be construed as conferring on you any right to any HOOPP Materials other than your limited right to use HOOPP Connect for your personal use and in accordance with these Terms of Use. Information on this website may be used by you only for your personal, non-commercial use, but may not be republished, retransmitted, reproduced, taken out of context or presented in a misleading or discriminatory manner. You also agree that you will not alter or remove any copyright, trademark, or any other notice from any authorized copy of the content on HOOPP Connect. Any rights not expressly granted to you are reserved by HOOPP. This provision will survive the termination of your right to use HOOPP Connect.

HOOPP CONNECT AND THE MATERIALS, CONTENT, TOOLS, LINKS, FORMS, AND SERVICES OFFERED THROUGH OR CONTAINED ON HOOPP CONNECT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
HOOPP makes no representations, warranties, guarantees or conditions of any kind, whether express or implied, arising from statute, course of dealing, usage of trade or otherwise, with respect to HOOPP Connect and the materials, content, tools, links, forms and services offered through or contained on HOOPP Connect. HOOPP disclaims all such representations, warranties, guarantees and conditions, including without limitation, representations, warranties, guarantees, and conditions of quality or fitness for a particular purpose, title, non-infringement of third party rights, error-free or uninterrupted service, accuracy, availability, usability, suitability, reliability, security, currency, and completeness. Modifications
HOOPP may at any time, and without notice to you, modify these Terms of Use or change the content of HOOPP Connect. Such modifications will be effective immediately upon being posted on HOOPP Connect. Your continued use of HOOPP Connect will indicate your acceptance of the modified Terms of Use. If you do not agree to any modification of the Terms of Use, you must immediately stop using HOOPP Connect.
General Terms
These Terms of Use
constitute the entire agreement between you and HOOPP with respect to your use
of HOOPP Connect and supersede all previous agreements, understandings, and
representations relating to your use of HOOPP Connect.
These Terms of Use will
be governed by, construed and enforced in accordance with the laws of the
Province of Ontario and the laws of Canada applicable therein. Each party
irrevocably submits to the exclusive jurisdiction of such courts.
No failure by HOOPP to
exercise any rights, powers, or remedies under the Terms of Use or its delay to
do so will constitute a waiver of these rights, powers, or remedies. The single
or partial exercise of a right, power, or remedy will not prevent its
subsequent exercise or the exercise of any other right, power, or remedy.
If any provision of the Terms of Use or part thereof is or becomes illegal, invalid, or unenforceable in any jurisdiction, the illegality, invalidity, or unenforceability of that provision will not affect the legality, validity, or enforceability of the remainder of the provision or provisions of the Terms of Use, as the case may be.
